General Understanding on AI and Copyright in Japan

The Copyright Act aims to find a balance between protecting the rights and interests of copyright holders and ensuring an appropriate use of the work being copyrighted. Increasing concerns have been voiced on the interpretation of the Copyright Act and the use of generative AI, in particular due to limited judiciary precedent. 

The General Understanding on AI and Copyright, released by Japan Copyright Office (CPO) aims at providing clarity on how Japan's current Copy Right Act should be applied in relation to AI technologies. The General Understanding differentiates the two main stages where there could be copyrights infringement. These are:  the training/ AI development stage and the generation/ utilisation stage. In addition, the copyrightability of AI-generated material is also considered.

The General Understanding answers questions on:

  • Training/ AI development stage: exploiting copyrighted work including for developing models which use data that has been create or trained on using copyrighted work.
  • Generation/ utilisation stage:  copyright infringements in the generation and utilisation of AI materials.
  • Copyrightability of AI-generated materials: the need to consider if the materials generated by AI are protected in terms of copyright, and which criteria should be considered when doing so.
