Federal Trade Commission Consumer Protection and Competition Investigations (Bias in Algorithms and Biometrics)

In 2021, the Federal Trade Commission (FTC) designated eight key areas of focus for enforcement and regulatory action, one of which directly implicate investigations in unfair, deceptive, anticompetitive, collusive, coercive, predatory, exploitative, or exclusionary acts or practices relating to algorithms and biometrics.

Initiative overview

The Federal Trade Commission approved a series of resolutions that will enable agency staff to investigate conduct in core FTC priority areas over the next ten years. The Bureaus recommended that the Commission authorize eight new compulsory process resolutions in these essential areas: (1) Acts or Practices Affecting United States Armed Forces Service Members and Veterans; (2) Acts or Practices Affecting Children; (3) Bias in Algorithms and Biometrics; (4) Deceptive and Manipulative Conduct on the Internet; and (5) Repair Restrictions. (6) Abuse of Intellectual Property; (7) Common Directors and Officers and Common Ownership; and (8) Monopolization Offenses. On 8 April 2020, the US Federal Trade Commission (FTC) published a business blog, titled "Using Artificial Intelligence and Algorithms".The initiative has the following objective(s):To investigate whether any persons, partnerships, corporations, or others have engaged or are engaging in unfair, deceptive, anticompetitive, collusive, coercive, predatory, exploitative, or exclusionary acts or practices relating to algorithms and biometrics, in or affecting commerce, including but not limited to bias in algorithms and biometrics, in violation of Section 5 of the Federal Trade Commission Act, 15 U.S.C. . 45, as amended or any statutes or rules enforced by the Commission.To determine the appropriate action or remedy, including whether injunctive and monetary relief would be in the public interest.
