Initiative overview
The AI initiative outlined in the White Paper aims to establish a comprehensive and ethical framework for the development, deployment, and governance of artificial intelligence technologies in Ukraine. The White Paper on AI Regulation (White Paper) was developed in 2024 based on the AI Regulation Roadmap. It laid the foundation for the bottom-up and gradual approach to AI regulation and alignment with the EU AI Act.
The essence of the approach is to divide the path to mandatory regulation into two stages:
1. The preparatory stage (2-3 years, before the adoption of a law that is analogous to the EU AI Act) includes facilitation of self- and co-regulation among stakeholders and providing them tools for compliance.
2. The implementation stage of law that is analogous to the EU AI Act. By that moment, Ukraine is ensuring the state’s and the industry's capacity to regulate and comply accordingly.
According to the White Paper, Ukraine is currently implementing the first stage of approach, which includes such policy instruments and soft law tools as:
- Sandbox;
- adaptation of the Council of Europe HUDERIA methodology;
- support of signment of the Voluntary Code of Conduct between AI companies and further establishment of self-regulatory organisations (currently 14 companies have signed it);
- publication of guidelines on AI for various sectors (guidelines for developers, higher educational institutions, civil servants, schools, intellectual property field, media, advertisement sector were already released. Guidelines for lawyers, courts, HR and some others are being developed)
Also, the Glossary of Terms on AI was developed as part of the implementation of the AI Regulation Roadmap and White Paper.
These measures introduce self-regulatory measures to ensure safe, secure AI deployment, respect human rights, and prepare stakeholders for future regulation.
Looking ahead, the initiative is expected to evolve through phased implementation and institutionalization within government structures, including the creation of dedicated bodies or commissions to oversee AI governance. It envisions continuous monitoring, evaluation, and updating of AI policies to keep pace with technological advancements. The initiative may also expand to cover cross-sectoral applications and international cooperation, aligning Ukraine’s AI policies with global best practices and standards."
